How long to get a patent issued, once we file it? Once we file a patent application, it typically takes 2-3 years to first hear back from the Patent Office. I can be faster if you want to pay more to the USPTO for a faster path at the Patent Office – that can be Track I examination, or another form of accelerated examination. Either way, there are additional fees to the USPTO, and additional conditions for preparing the patent application that we must follow. With Track I examination, we'll typically hear back from the USPTO within 3 or 4 months, and we'll have shortened time periods for reply, so that the full course of examination of the patent application, to a second Office Action on the application, can be done within about one year. This is much faster than the typical 3-5 years to reach the same point with the ordinary course of patent examination.
That point in the examination process, which is typically an allowance of some (or all) patent claims, and/or a "final rejection" of patent claims, is not necessarily the end of the road for the patent application.
